What is a notarial services attorney in Thailand, and how do they differ from notaries elsewhere?
In Thailand, the role of a notary public as understood in common-law countries does not formally exist. Instead, the Lawyers Council of Thailand authorises specific attorneys to act as notarial services attorneys. These professionals authenticate documents, verify identities, certify true copies, and prepare notarial certificates that are recognised by Thai authorities and accepted for international use. The scope of their work is defined by Thai regulations rather than by common-law convention.
Which types of documents can be authenticated?
Common documents include powers of attorney, affidavits, statutory declarations, company resolutions, certificates of incorporation, shareholder agreements, and personal declarations. If your document type is not listed, we are glad to discuss whether notarial authentication is the appropriate step and, if so, how to proceed.
How long does a single-document authentication appointment take?
Most single-document appointments are completed within 30 to 45 minutes at our Silom Road office. We ask that you bring valid identification documents and, where applicable, the relevant supporting materials. If additional time may be needed — for instance, for complex corporate instruments — we will advise you in advance of the appointment.
Do authenticated documents require apostille or legalisation for use abroad?
Thailand is a member of the Hague Apostille Convention. Documents authenticated by a notarial services attorney and then apostilled by the Ministry of Foreign Affairs are accepted in all member countries without further legalisation. For non-member countries, further consular legalisation may be required. We can advise on the specific chain of authentication your receiving authority requires.
Is the travelling notarial service available outside Bangkok?
The travelling service is primarily offered within Bangkok and the adjacent metropolitan area. Engagements further afield may be possible by arrangement; please contact us to discuss your location and the scope of the documents involved so we can advise on feasibility and any additional considerations.
How is the corporate retainer structured, and what does it include?
The retainer operates on a twelve-month basis. It covers a defined monthly number of document authentications — agreed at the outset based on your anticipated volume — along with a quarterly written summary of work performed. Authentications beyond the agreed monthly allowance are billed at a documented per-item rate. The retainer suits subsidiaries of multinational groups or companies with board-cycle documentation requirements.
